Case of Lexmark International. In the case of Lexmark International, Inc., sells the only style of toner cartridges that work with the company’s laser printers.  Other businesses – remanufacturers – acquire and refurbish used Lexmark cartridges to sell in competition with the cartridges sold by Lexmark.  Static Control Components, Inc., makes and sells components for the remanufactured cartridges, including microchips that mimic the chips in Lexmark’s cartridges.  Lexmark released ads that claimed Static Control’s microchips illegally infringed Lexmark’s patents.  Lexmark then filed a suit in a federal district court against Static Control, alleging violations of intellectual property law.  Static Control counterclaimed, alleging that Lexmark engaged in false advertising in violation of the Lanham Act.  The court dismissed the counterclaim.  On Static Control’s appeal, the U.S. Court of Appeals for the Sixth Circuit reversed the dismissal.  Lexmark appealed. The United States Supreme Court affirmed the lower court’s ruling.  The Supreme Court’s decision clarified that businesses do not need to be direct competitors to bring an action for false advertising under the act.

Case of Lexmark International

A cause of action for false advertising under the Lanham Act extends to plaintiffs whose interests “fall within the zone of interests protected by the law.”  To establish a claim, a plaintiff must allege an injury to a commercial interest in reputation or sales proximately caused by a violation of the statute.  Static Control met this test. Under the Court’s ruling in this case, is Static Control now entitled to relief?  Explain your answer. Prison Culture. A Guardian reporter, speaking about England, wrote: “Anyone going to jail in this country has to adapt to a cynical, corrupt, antisocial lifestyle which does little to encourage change in post-prison behaviour” (James, 2015). This quote implies that prison culture is notably different from the culture at large, and though it speaks specifically of England, we can apply it to U.S. culture as well. For this discussion answer the following questions. What do you see as the key elements of the convict code in prison culture? What are the key elements of our culture’s moral code? Are there differences as well as similarities?  Do some subcultures of the United States reflect the convict code more closely than others? The Influence of Peers. “If Johnny jumps off a cliff are you going to jump, too”? This is a cliché used often by parents wanting to convince their children that doing what “everyone else does” is not always a good idea. For example, binge drinking is an increasing problem on college campuses, often with dire consequences (e.g., alcohol poisoning, unprotected sex, expulsion from school). Given the consequences, one wonders what compels college students to engage in such risky behavior. We know that fitting in—being accepted by others—is a primary motive for doing what others do. In this case, conforming to one’s referent group’s norms (i.e., getting drunk is cool) gains one’s acceptance to that group (Talbott, Wilkinson, Moore, & Usdan, 2014; Wardell & Read, 2013). Refusal to comply means rejection by the group. Binge drinking, clearly, is not in the best interest of individual college students, unless you consider the importance of belonging to and acceptance by the group. For this Discussion, you explore persuasion strategies with respect to the effects of peer influence on behavior.

TO PREPARE
