 Correctional Officers & Inmates Rights

Hudson v. McMillianLinks to an external site. is a U.S. Supreme court case involving the excessive force resulting in a claim of cruel and unusual punishment under the Eighth Amendment. The court’s decision resulted in the five-pronged Hudson test, also known as PANAM:

(P)erceived threat by correctional officers;

(A)ny and all efforts to de-escalate;

(N)eed for the application of force;

(A)mount of force that was used and;

(M)edical issues, and extent of any injuries, that are used to evaluate cases involving any use of force before trial and after conviction. The test helps the courts determine whether correctional officers’ actions were reasonable, necessary, and conducted in good faith. Watch the video scenario and take notes as you watch: CJ in Practice Constitutional Issue: Deprivation of Inmates’ RightsLinks to an external site.

Cultural Diversity Discussion

Discussion Prompts

Prompt #1

How do you define “cultural diversity”? Do you think the way you define cultural diversity is the same or different than how others might define it? What elements contribute to a person’s “cultural identity”? What if everyone in the world had the same cultural identity? Do you think this would be a place you’d want to live? Why are discussions about cultural identity important?

(USLOs 1.1, 1.2, 1.3)

Prompt #2

Cultural Diversity Discussion. Share with us some of your personal and cultural identities. Please share 6 aspects of yourself with the group. Here are some identity categories, for example:

Cultural Heritage(s)
Nationality(-is)
Family
Race/Ethnicity
Religion/Religious influences
Sexual Identity
Disability Status
Language Community(-is)
Character trait(s)
Do any of these identities relate to one another, if so, how? What would a person who read about your identity be able to reveal about you? What would a person who read about your identity not be able to tell about you? Do any of your cultural identity groups practice allyship? If they do not practice allyship, how might they engage in activities to be more inclusive and equitable?

Measure of Center

Watch three videos (“Measure of Center ‘Mean,'” “Measure of Center ‘Median,'” and “Measure of Center ‘Mode'”) in the Calculations section of “The Visual Learner: Statistics,” located in the Topic 2 Resources.

Go to the Random.org website, provided in the Topic 2 Resources, to generate a set of random numbers. Click on the “Get Sets’ link at the bottom left of the page to generate some data. (Note: If you are not able to access the link, you can randomly generate 10 numbers yourself for this calculation.)

Measure of Center

Imagine these numbers are the care satisfaction scores from a recent sample of discharged patients. Randomly select one row of numbers to use for the following calculations:

What was the mean?
What was the median?
What was/were the mode/s?
Given that the range of data was between 1 and 20, what do these numbers tell you about the overall satisfaction of the patients?
If you were reporting these scores back to your supervisor, how would you explain or interpret these satisfaction scores?

Initial discussion question posts should be a minimum of 200 words and include at least two references cited using APA format. Responses to peers or faculty should be 100-150 words and include one reference. Refer to “Discussion Question Rubric” and “Participation Rubric,” located in Class Resources, to understand the expectations for initial discussion question posts and participation posts, respectively.

Citizens Rights Part One

Overview

It is important to understand your responsibilities as a criminal justice professional when engaging with citizens. This piece is broken into three parts and you must complete each part. Each part includes a text or video scenario to which you will respond by writing 1-2 pages for each scenario that examines specific information regarding the events using your knowledge of the United States Constitution.

Instructions

Part 1: Law Enforcement Officer Arrives at the Scene Scenario

An 18-year-old high school student walks to class carrying a backpack. He is stopped by the school security guard and his backpack is searched. A loaded handgun is discovered. The school security guard takes the student to the principal’s office. The principal calls the local police. In the state where the school is located, it is illegal to carry a concealed weapon without a permit and all weapons are prohibited on campus.

Citizens Rights Part One

Officer Smith arrives at the school approximately 10 minutes later. Officer Smith takes a statement from the school security guard and searches the student’s backpack. He seizes the gun and places the student under arrest. Officer Smith then asks the student if he would like to make a statement to explain why he was carrying a concealed weapon on campus.

The student replies, “What weapon? That’s not my backpack and I never saw that gun before.”

The student is then transported to the local jail. However, on the way to the local jail, Officer Smith asks the student again why he brought a loaded gun on campus. The student admits that it was his gun and stated that he needed it for protection. Upon arrival at the local jail, the student is booked. Six hours later, the student is interviewed by a Detective Columbo. The detective reads the student his Miranda warning and asks the student if he would like to make a statement.

The student replies, “No, I want a lawyer.”

Citizens Rights Part One

Write 1-2 pages in which you:

Examine the constitutional amendment or amendments that would relate to this situation. Outline the appropriate procedures you would need to follow to comply with the associated amendments to ensure admissibility of evidence. Evaluate the officer’s actions and determine whether his search, the student’s confession, and the weapon discovery were lawful and/or admissible. Provide a rationale for your opinion.

Use at least two sources to support your writing. Choose sources that are credible, relevant, and appropriate. Cite each source listed on your source page at least one time. Parole – Plan of Action. Details of the Program You are Designing. You are to design a program to prepare a group of 20 incarcerated men OR women to be released back into society. It cannot be a program for both men and women—select one or the other. You will design and present your program as a power point presentation (PPP).

These inmates have been incarcerated for between 10 and 15 years and are to be released on parole; that is, if they are not successful in their release, they will be returning to prison. Keep in mind that they were model prisoners, participated in the prison work programs and completed all rehabilitation and skills programs that they were allowed to complete. Think about what society was like for them before they were incarcerated and what might have changed. Parole – Plan of Action. Think about how fast technology has changed. How are you going to prepare them during the last six months of their incarceration? You can determine how long the training program will last; from 2 weeks to 6 months. This is one time where you will submit your power point presentation as an attachment in the Discussion area.

Parole – Plan of Action

Parole – Plan of Action. I want you to come up with an innovative plan of action. However, your goal is to “sell” your plan to your classmates. Your classmates serve as the committee who is funding the program and will release $500,000 to each of the best 3 presentations. (Disclaimer: You will not actually receive the funds, this is an exercise for this class only.) Keep the presentation simple as you address these points.

Guidelines for the Power Point Presentation

  1. Put the title of the program and names of those who worked on the power point presentation on the first slide. Don’t forget the names!
  2. List the goals of your program. Remember, use action words. Here’s an APA document to writing goals or objectives: Writing Behavioral Learning Objectives and AssessmentsLinks to an external site.
  3. Specifically list what you would put into your training and preparation program.
  4. Explain how you would carry out the training.
  5. Present a one-page budget of how the $500,000 funds will be allocated. For example, would you need a manager to oversee the program, would you hire outside specialists, would you purchase educational material, or how would you spend the money.
  6. Keep the power point within 6-10 slides. Do not go over 10 slides. Be concise.

Workplace Legal & ethical standards

 Accurate documentation and record keeping are vital to the profession. Documenting that the research subject (client/patient) has read and understood both 1) informed consent to research participation (treatment), and 2) the legal ramifications of mandated instances in which treatment-related information must be released are ethically imperative. In the workplace, it is critical to apply due diligence by continually monitoring, reviewing, and investigating current practices performed, to confirm that they adhere to the APA code of ethics and standards of the profession.

Workplace Legal & ethical standards

  • Analyze the ethical issues related to documenting informed consent and ethical release of treatment and assessment records.
  • Which enforceable standards are relevant to the release of treatment-related materials and disclosure of information arising out of treatment?
  • Provide specific examples of what each enforceable standard requires or prohibits.
  • Provide a rationale for your proposed actions in your example and why they are consistent with ethical guidelines.
  • Evaluate the legal issues associated with assessment, testing, and diagnosis documentation in professional psychology.
  • What specific legal issues can arise in documenting assessment, testing, and diagnosis?
  • Provide specific examples that support your evaluation.
  • Provide a rationale for your proposed actions in your example and why they are consistent with legal requirements.
