Literature Short Assignment

Topic #1:  (Relating to “The Quadroons”). In addition to its literary significance, the short fictional story “The Quadroons” is important because of its historically persuasive message/theme. Lydia Maria Child wrote this story to be included in an anti-slavery publication called The Liberty Bell, first published in 1842. This was nineteen years before the Civil War began in 1861, but the Abolitionist Movement (to abolish slavery) was gaining strength and momentum. Child’s purpose was to show the emotional, spiritual, and physical devastation caused by slavery, particularly to readers in the Northern states. Many people in the North (where slavery had been abolished for the most part by 1800) knew of slavery only from a distance, literally and figuratively. Child provides a fictional but also realistic example of life in a state where slavery was legal, in this case, Georgia. By the end of this story, all of the key characters are dead, similar to what we would expect to see in a Shakespearean tragedy. In this case, the tragedy is slavery itself. How effective do you think “The Quadroons” is in illustrating the author’s and other Abolitionists’ ethical/moral/legal views about slavery? A common question at the time was “how could Xarifa become a slave when neither she nor her mother, Rosalie, had ever been slaves?” The story answers this question in a way that was surprising and appalling to readers who were unfamiliar with these circumstances of slavery. Discuss your thoughts on these issues and any others that are relevant to the story.

Topic #2:  (Relating to “The Quadroons”). As stated in the above topic, this story is undoubtedly a tragedy for all the main characters, but particularly for Rosalie and Xarifa. Lydia Maria Child’s fictional but also realistic story has elements of Shakespearean and Ancient Greek tragedy as well. For example, all the main characters are dead before the story ends. Some of these characters, particularly Edward have “fatal flaws” that contribute to their own deaths and the overall tragedy of the story. In Edward’s case, he allows his political ambitions to take precedence over his love for Rosalie, even though he regrets this decision almost immediately. In fact, he becomes so miserable in his loveless marriage to Charlotte that he becomes an alcoholic and dies when he falls off his horse, which he was riding while drunk. In addition, the central tragedy of this story is that all the characters are living under the rules and laws of an evil system: slavery. No matter how well intentioned many of these individual characters are, they are doomed by the system under which they must live. Even though Edward does everything he can to protect his daughter, Xarifa, and Charlotte continues this support and protection after Edward dies, nothing can prevent what ultimately happens to Xarifa, even her beloved George, who also tries to rescue her and ends up being shot and killed. The slave who acts as a “double agent” and betrays Xarifa is also a victim of the evil system. How does this interpretation align with the author’s purpose in revealing the hopelessness of living with the evil of slavery? Discuss your thoughts on these issues and any other aspects of the story that you find interesting.

Topic #3:  (Relating to Lincoln’s “House Divided” Speech).  Delivered at the Illinois State Capitol in 1858 after Lincoln had accepted the Illinois Republican Party’s nomination for U.S. Senator, this is one of his most famous speeches leading up to the Civil War. Although Lincoln lost this 1858 Senate election, many historians believe that this speech had a significant role in his winning the Presidential election in 1860. His position on slavery is clear, and he does not hesitate to explain his reasons with strong, supporting evidence. He is also very clear about his Democratic opponent’s position on slavery (Stephen Douglas). Lincoln draws upon a variety of moral, ethical, and religious beliefs in this speech, including the Biblical quotation from the New Testament about “a house divided.” Discuss the specific evidence that Lincoln uses to make this speech as powerful and persuasive as it is. Also discuss any other aspects of the speech that you choose. APA.

Privacy Impact Assessment (PIA)

A privacy impact assessment (PIA) is a process to help you identify and minimize data privacy risk. Specifically, this type of assessment helps identify the risks to an individual when an organization collects personal information for a business purpose. There are many reasons an organization might collect personal data. For example, all businesses must collect personal information from employees to process payroll taxes. Many businesses collect personal information from customers to ship goods and services or conduct research to create new products.An organization should complete a PIA any time it intends to collect a new data element from an individual, such as name, date of birth, age, race, sex, address, biometric identifier, or any other element of personal data. Completing a PIA helps an organization think deeply about privacy issues and risks related to collecting specific types of data.

Clearly specify the data that it wishes to collect from a person.

Clearly document why it must collect that data.

The Rights of Citizens

Overview

It is important to understand your responsibilities as a criminal justice professional when engaging with citizens. This assignment is broken into three parts and you must complete each part of the assignment.

Each part includes a text or video scenario to which you will respond by writing a 1-2 page paper for each scenario that examines specific information regarding the events using your knowledge of the United States Constitution.

Part 1: Law Enforcement Officer Arrives at the Scene Scenario

An 18-year-old high school student walks to class carrying a backpack. He is stopped by the school security guard and his backpack is searched. A loaded handgun is discovered. The school security guard takes the student to the principal’s office. The principal calls the local police. In the state where the school is located, it is illegal to carry a concealed weapon without a permit and all weapons are prohibited on campus.

Officer Smith arrives at the school approximately 10 minutes later. Officer Smith takes a statement from the school security guard and searches the student’s backpack. He seizes the gun and places the student under arrest. Officer Smith then asks the student if he would like to make a statement to explain why he was carrying a concealed weapon on campus.

The student replies, “What weapon? That’s not my backpack and I never saw that gun before.”

The student is then transported to the local jail. However, on the way to the local jail, Officer Smith asks the student again why he brought a loaded gun on campus. The student admits that it was his gun and stated that he needed it for protection. Upon arrival at the local jail, the student is booked. Six hours later, the student is interviewed by a Detective Columbo. The detective reads the student his Miranda warning and asks the student if he would like to make a statement.

The student replies, “No, I want a lawyer.”

Write a 1-2 page paper in which you:

Examine the constitutional amendment or amendments that would relate to this situation.

Outline the appropriate procedures you would need to follow to comply with the associated amendments to ensure admissibility of evidence.

Part 2: Arrest and Trial Scenario

Tyler, a well-known escort service provider in his community, is suspected of the murder of an escort who worked for him. The local police meet Tyler at the airport when he arrives from a trip to Cancun. He is arrested for his suspected connection to the murder of the escort. The police do not inform Tyler of his right to remain silent or his right to counsel. They immediately begin to interrogate him. They continue to question him until he admits that he knew the prostitute and that she worked for him. He also admits that he was with her the night of the alleged murder. Tyler is transported to the local jail and booked. The prosecutor files charges of first degree murder against Tyler. Tyler does not waive his rights to a speedy trial. He asks that an attorney be appointed and demands a trial by jury.

Part 3: Correctional Officers and Rights of Inmates

Hudson v. McMillianLinks to an external site. is a U.S. Supreme court case involving the excessive force resulting in a claim of cruel and unusual punishment under the Eighth Amendment. The court’s decision resulted in the five-pronged Hudson test, also known as PANAM:

(P)erceived threat by correctional officers;

(A)ny and all efforts to de-escalate;

(N)eed for the application of force;

(A)mount of force that was used and;

(M)edical issues, and extent of any injuries, that are used to evaluate cases involving any use of force before trial and after conviction.

The test helps the courts determine whether correctional officers’ actions were reasonable, necessary, and conducted in good faith.
