Hudson v. McMillianLinks to an external site. is a U.S. Supreme court case involving the excessive force resulting in a claim of cruel and unusual punishment under the Eighth Amendment. The court’s decision resulted in the five-pronged Hudson test, also known as PANAM:

(A)ny and all efforts to de-escalate;

(N)eed for the application of force;

(A)mount of force that was used and;

(M)edical issues, and extent of any injuries, that are used to evaluate cases involving any use of force before trial and after conviction. Tyler, a well-known escort service provider in his community, is suspected of the murder of an escort who worked for him. The local police meet Tyler at the airport when he arrives from a trip to Cancun. He is arrested for his suspected connection to the murder of the escort. The police do not inform Tyler of his right to remain silent or his right to counsel. They immediately begin to interrogate him. They continue to question him until he admits that he knew the prostitute and that she worked for him. He also admits that he was with her the night of the alleged murder. Overview

It is important to understand your responsibilities as a criminal justice professional when engaging with citizens. This piece is broken into three parts and you must complete each part. Each part includes a text or video scenario to which you will respond by writing 1-2 pages for each scenario that examines specific information regarding the events using your knowledge of the United States Constitution.

Part 1: Law Enforcement Officer Arrives at the Scene Scenario

An 18-year-old high school student walks to class carrying a backpack. He is stopped by the school security guard and his backpack is searched. A loaded handgun is discovered. The school security guard takes the student to the principal’s office. The principal calls the local police. In the state where the school is located, it is illegal to carry a concealed weapon without a permit and all weapons are prohibited on campus.

Officer Smith arrives at the school approximately 10 minutes later. Officer Smith takes a statement from the school security guard and searches the student’s backpack. He seizes the gun and places the student under arrest. Officer Smith then asks the student if he would like to make a statement to explain why he was carrying a concealed weapon on campus.

The student replies, “What weapon? That’s not my backpack and I never saw that gun before.”

The student is then transported to the local jail. However, on the way to the local jail, Officer Smith asks the student again why he brought a loaded gun on campus. The student admits that it was his gun and stated that he needed it for protection. Upon arrival at the local jail, the student is booked. Six hours later, the student is interviewed by a Detective Columbo. The detective reads the student his Miranda warning and asks the student if he would like to make a statement.

The student replies, “No, I want a lawyer.”

Parole – Plan of Action. Details of the Program You are Designing. You are to design a program to prepare a group of 20 incarcerated men OR women to be released back into society. It cannot be a program for both men and women—select one or the other. You will design and present your program as a power point presentation (PPP).

These inmates have been incarcerated for between 10 and 15 years and are to be released on parole; that is, if they are not successful in their release, they will be returning to prison. Keep in mind that they were model prisoners, participated in the prison work programs and completed all rehabilitation and skills programs that they were allowed to complete. Think about what society was like for them before they were incarcerated and what might have changed. Parole – Plan of Action. Think about how fast technology has changed. How are you going to prepare them during the last six months of their incarceration? You can determine how long the training program will last; from 2 weeks to 6 months. This is one time where you will submit your power point presentation as an attachment in the Discussion area.

Workplace Legal & ethical standards

 Accurate documentation and record keeping are vital to the profession. Documenting that the research subject (client/patient) has read and understood both 1) informed consent to research participation (treatment), and 2) the legal ramifications of mandated instances in which treatment-related information must be released are ethically imperative. Safety Training Program

SAFETY FIRST: CASE STUDY

BNSF Railway is a North American freight transportation company with over 32,000 miles of routes. BNSF Railway hauls agricultural, consumer, and industrial products and coal. Safety Training Program

Approaching Others About Safety (AOAS) is a training program for all BNSF Railway employees. Four hundred and fifty BNSF Railway employees train their peers. Employees serve as trainers because page 200BNSF Railway believes they are in the best position to keep themselves and their peers safe.

The goal of the program is for BNSF Railway employees to be confident about giving feedback to each other about safe behavior and avoiding unsafe situations. Employees need to learn the value of providing feedback when they see unsafe behavior or situations, including positively recognizing when someone is working safely or correcting them when they perceive another employee is at risk. Training should focus on the types of exposures that tend to result in the most injuries, including walking/path of travel around trains, rails, and equipment, pinch points between the railway cars, and climbing or descending locomotives and railway cars.

Overview

Before researching a behavior, it is important to first identify and define it. All experiments must have a behavior (dependent variable), at least one participant, and a setting where they take place. For this assignment, you will start writing the Introduction and the Methods section of your hypothetical behavior analytic study. Consider an area of research that interests you. Then, select a specific action, population, and setting for your hypothetical study.

Complete the following sections of your hypothetical behavior analytic study. Use the Hypothetical Behavior Analytic Study Template [DOCX] to complete this assignment. For each assignment you will add new sections.

Introduction

Select and operationally define a dependent variable (action). Your operational definition should be brief (1¿2 sentences), objective, clear, and complete.

  • Objective refers to unambiguous description of the actions; void of mentalistic words. An operational definition that meets the objective criteria is one that is observable and measurable.
  • Clear refers to what a person says or does; the topography is clearly defined in such a manner that two observers will have a high agreement when the behavior is observed.
  • Complete refers to the boundaries of what is included and excluded. To discriminate the boundaries of the operational definition, include examples and nonexamples with minimal differences.
